BOpen Terms of Service

Provider: Bellator Tech Ltd ("we", "us", "our")
1. Introduction and Service Scope
These Terms of Service ("Terms") govern your use of the BOpen software application and API services provided by Bellator Tech Ltd. By accessing or using BOpen, you agree to be bound by these Terms.
BOpen operates as an authorized Third-Party Provider (TPP) utilizing regulated Open Banking standards. We provide two primary services:
- Account Information Services (AIS): Allowing you to consolidate, view, and analyze read-only financial data from your supported payment accounts.
- Payment Initiation Services (PIS): Allowing you to initiate direct account-to-account payments from your bank account to designated payees.
Important Note: Bellator Tech Ltd is not a bank or credit institution. We do not accept deposits, hold client funds, issue credit, or provide financial advice.
2. Eligibility and Account Linking
To use BOpen, you must satisfy the following criteria:
- Be at least 18 years of age.
- Hold an active payment account with a supported Account Servicing Payment Service Provider (ASPSP / Bank) located in the United Kingdom or EEA.
- Successfully authenticate your identity directly with your bank using Strong Customer Authentication (SCA).
You are solely responsible for ensuring you have the legal right to link and share information from any account you connect to BOpen.
3. Open Banking Consents and Explicit Permission
3.1 AIS Consents
- Granting Access: To display your financial data, you grant us permission to access your account details, balances, and transaction histories via secure Open Banking APIs.
- Duration & Re-authentication: AIS consents are valid for a specified period (up to 90 days or as governed by applicable regulation). You may be prompted to re-authenticate with your bank to maintain continuous access.
- Revocation: You can revoke your AIS consent at any time directly through the BOpen application settings or via your bank's online banking portal/mobile app.
3.2 PIS Consents
- Single Payment Requests: Payment initiation consents are granted on a per-transaction basis. You must explicitly authorize each payment using your bank’s authentication system.
- Variable Recurring Payments (VRP): If you set up recurring payment instructions, you authorize us to submit payment requests strictly within the limits, frequency, and expiry parameters you approve.
4. Payment Execution and Finality (PIS)
- Transmission: Once authorized, BOpen immediately transmits your payment instruction to your bank for execution.
- Irrevocability: Because payments are processed directly by your bank via local clearing systems (e.g., Faster Payments), payment instructions cannot be cancelled or reversed through BOpen once authorized via SCA.
- Bank Responsibility: Your bank remains responsible for executing the transaction, deducting funds from your account, and handling payment settlement. Bellator Tech Ltd is not liable for delays or execution failures caused by your bank.
5. Security and User Responsibilities
- Credential Protection: BOpen will never ask for your bank login credentials, passwords, or PINs. All authentication takes place directly on your bank’s secure interface.
- Device Security: You are responsible for maintaining the security of your device, access credentials, and authentication methods used to log into BOpen.
- Unauthorized Activity: You must notify us immediately at security@bopen.tech if you suspect unauthorized access to your BOpen account or linked bank accounts.
6. Service Availability and Data Accuracy
- Third-Party Data Reliance: BOpen relies on APIs provided by third-party financial institutions. We cannot guarantee that account data provided by your bank will be error-free, complete, or updated in real time.
- Service Interruptions: Access to Open Banking services may be temporarily suspended for scheduled maintenance, system updates, or unannounced outages at your bank or downstream infrastructure providers.
7. Limitation of Liability
To the maximum extent permitted by law, Bellator Tech Ltd shall not be liable for:
- Indirect, incidental, or consequential losses arising from your use of BOpen.
- Delayed or failed payments caused by inaccurate payee details provided by you.
- Operational outages, technical failures, or refusal of execution by your bank (ASPSP).
- Financial decisions made based on bank account data displayed within the application.
8. Suspension and Termination
- By You: You may terminate your agreement with BOpen at any time by deleting your account and revoking all active Open Banking consents.
- By Us: We reserve the right to suspend or terminate your access to BOpen immediately if we suspect fraudulent activity, breach of these Terms, regulatory non-compliance, or severe security risks.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
